User Agreement

This Agreement is a public offer made by BiccomTech LLP (hereinafter, the “Operator”) and sets out the terms of use of the Hatmail email service available at https://hatmail.kz (hereinafter, the “Service”).

By registering a mailbox, the user, in accordance with Articles 395 and 396 of the Civil Code of the Republic of Kazakhstan, fully and unconditionally accepts the terms of the Agreement. A user who does not agree with the terms must not register or use the Service.

1. Definitions

  • Service — the Hatmail software system that makes it possible to receive, store and send email through a web interface and email client applications.
  • User — an individual who has registered a mailbox.
  • Mailbox — the User’s account with an address in the form name@hatmail.kz and the storage space allocated to it.
  • Credentials — the mailbox address and the password.

2. Registration and the Mailbox

Registration is open to persons with full legal capacity who have reached the age of 18. Persons aged 14 to 18 use the Service with the consent of their legal representatives.

When registering, the User provides a first name, a last name, the desired address, a password and a mobile phone number, which is confirmed by an SMS code. The User undertakes to provide accurate information.

No more than three mailboxes may be registered to one phone number.

The mailbox address is chosen from those that are available. The Operator may refuse to register an address that coincides with a system name, is misleading as to the identity of the sender, or infringes the rights of third parties.

The User is responsible for keeping the password secure and for all actions performed using the User’s credentials. If there is reason to suspect that the password has become known to other persons, it should be changed immediately.

Access to the mailbox is restored by means of a code sent to the phone number provided at registration.

3. Terms of Provision of the Service

The Service is provided free of charge. The storage capacity of one mailbox is 5 gigabytes.

The Service operates in beta testing and is provided “as is”. The Operator takes reasonable measures to ensure uninterrupted operation but does not guarantee the absence of interruptions, errors or delays in the delivery of messages.

To protect users and the reputation of the Service, limits apply to the number of messages that may be sent. The current values are set out in the Service Rules.

The Operator may change the features of the Service, introduce and lift restrictions, and carry out maintenance work. Where possible, the Operator gives advance notice of work that makes the Service unavailable for an extended period.

Incoming and outgoing messages are automatically checked for spam and malicious attachments. Messages identified as spam are placed in the Spam folder; messages with dangerous attachments may be rejected.

The User may connect to the Service up to five of the User’s own mailboxes held with other email services (the “Other mailboxes” section of the settings). On the User’s instruction, the Service signs in to such a mailbox with an app password that the User creates with that email service, copies its incoming and sent messages to the User’s mailbox, and sends messages from the address of that mailbox through the servers of the same email service. Copying is one-way: actions performed on the copies of messages in the Service do not change the original mailbox. The copies of messages take up space in the mailbox storage. The User may at any time disconnect the mailbox in the settings or revoke the app password with the email service.

Operation of a connected mailbox depends on the email service to which it belongs: the Operator is not responsible for its availability, its restrictions or changes to its access rules.

4. Rights and Obligations of the User

The User is entitled to use the Service for personal purposes, to access the User’s messages through the web interface and email client applications, and at any time to stop using the Service and request deletion of the mailbox.

The User undertakes to comply with the legislation of the Republic of Kazakhstan, this Agreement and the Service Rules, which form an integral part of it.

By connecting a mailbox held with another email service, the User confirms that the mailbox is the User’s own or that the User is entitled to dispose of it, and undertakes to comply with the terms of that email service. Connecting mailboxes belonging to others without the consent of their owners is prohibited.

5. Rights and Obligations of the Operator

The Operator undertakes to keep the Service running, to store the User’s messages and to protect the User’s personal data in accordance with the Privacy Policy.

The Operator does not read the content of messages and does not use it to display advertising. Automated processing of messages is carried out solely for delivery, search within the mailbox, and protection against spam and malware.

The Operator may suspend or terminate access to a mailbox if the User breaches the Agreement or the Service Rules, and also at the request of authorized state bodies in the cases provided for by law.

The Operator may delete a mailbox that has not been signed in to for more than 12 consecutive months, after first sending a notice by SMS at least 30 days in advance.

6. Liability

The User is solely responsible for the content of the messages the User sends and for the consequences of sending them.

The Operator is not liable for the content of messages received by the User from third parties, for failures of communication networks and equipment that do not belong to the Operator, or for losses arising from the User’s disclosure of credentials to other persons.

Since the Service is provided free of charge, the Operator’s liability is limited to the cases expressly provided for by the legislation of the Republic of Kazakhstan, including the legislation on consumer protection and on personal data.

7. Term and Termination

The Agreement is in force from the moment the mailbox is registered until it is deleted.

The User may stop using the Service at any time by sending, from the mailbox, a request for its deletion to support@hatmail.kz. The mailbox and the messages are deleted within the periods specified in the Privacy Policy.

After a mailbox has been deleted, its address may be unavailable for re-registration.

8. Amendments to the Agreement

The Operator may amend the Agreement. The new version is published on this page with its date indicated. The Operator gives notice of material changes by a message sent to the User’s mailbox at least 10 days before they take effect.

Continued use of the Service after the changes take effect constitutes acceptance of the new version.

9. Governing Law and Disputes

The Agreement is governed by the law of the Republic of Kazakhstan.

Claims are to be sent to support@hatmail.kz and are considered within 15 business days. If a dispute cannot be settled, it is referred to a court in accordance with the legislation of the Republic of Kazakhstan.
